The Azerbaijani Cabinet of Ministers made amendments to the “Regulations concerning the rights of foreign donors on grants in the territory of Azerbaijan”.
According to APA, the provision regulates the right to provide foreign donor grants in the territory of Azerbaijan by international organizations and their representations, foreign governments and their representations, charitable, humanitarian and other public international organizations, financial and credit institutions, foreign public organizations operating in the fields of education, science, health, arts and sports, including foundations, associations, federations and committees, as well as branches and representative offices of foreign legal entities registered in Azerbaijan.
According to the amendment, the ban on the conclusion of grant agreements by foreign donors who applied to the Ministry of Finance has been lifted. According to the amendments made to the rules of the grant agreements registration, submission of documents in connection with the registration of grant agreements of foreign donors and obtaining feedback about the financial and economic viability of the grant will be implemented in accordance with the rules on obtaining the rights by foreign donors to the issuance of grants in the territory of Azerbaijan, approved by the resolution of the Cabinet of Ministers on the principle of “single window” within 30 days. Under the new order, if the documents are drawn up abroad, they must be legalized or bear an apostille. In the case of drawing up the documents in a foreign language, they must be accompanied by a translation.
Prior to that, the Ministry of Finance considered the grants requests for 15 days, now this period is reduced to 7 days. If there is a request for a feedback about the financial and economic viability of the grant provided by foreign donors, the Ministry of Finance within 3 working days must notify the donor (the recipient). Under the changes, in the case of a submission of the evaluation to the coordinating body by the Ministry of Finance on the financial and economic viability of the grant, foreign donors will be deemed to have received the right for a grant.
