Three workers lost their appeals and will spend three years in jail for raping their roommate.

The Pakistanis, aged 19, 21 and 30, sneaked into the room that they shared with their countryman, pinned him down and gang-raped him in January 2016. In November, Dubai Court of First Instance jailed them for three years each for gang-raping their roommate at their labour accommodation in Jebel Ali.

They appealed the primary judgements and sought to have their imprisonment overturned before the Appeal Court.

The defendants contended that they had consensual sex with the roommate arguing that they did not rape the claimant.

Presiding judge Saeed Salem Bin Sarm rejected the defendants’ appeals and upheld their primary jail terms.

The three accused will be deported after serving their punishments, said the presiding judge Bin Sarm.

Records said the trio used physical violence to pin their roommate to the bed where he was sleeping before raping him one after the other.

The roommate testified before the court that the incident happened shortly after he woke up to someone touching his back.

“I woke up suddenly to someone feeling my back at around 11pm. When I tried to use the mobile’s light to see who it was, I saw the three defendants. They asked to have sex with me, but I refused. They all seemed drunk. When I tried to exit the room, they prevented me. They restrained me and raped me one at a time. One of them slapped me when I tried to resist. Another defendant gagged me when I tried to shout and cry for help. They overpowered me and abused me sexually,” he testified.

A policeman testified: “When we reached the labour accommodation where the incident happened, I saw the claimant petrified and quivering. Upon recording his statement, he said that he had been raped by the three assailants.”

The 19-year-old and the 21-year-old testified during prosecution questioning that they had indulged in sexual activity with their roommate before and this had not been the first time.

The appellate ruling remains subject to appeal before the Cassation Court within 25 days.
